Caught doing 70 mph in 45 mph zone, but not true. Cop got it wrong?

It was one of those "end-of-the-month-and-we-need-the-money" speed traps. Two biker cops with doughnuts up their rear ends were on duty. I was stopped and given a ticket. I was going 55mph in a 92 Accord. The officer said I was going 70. I seriously thought the cop was having fun with me. 70 in a 45 zone, that's some serious shit. I was doing 55 (this car needs to be in 5th gear in 70 so you dont F up the engine, plus on a local road, at 3:30pm, the traffic was so dense, 70 is near impossible). Here's my question:

Is there any way on earth the cop made a mistake, or his fucking toy radar gun jammed and gave an assworthy reading? I am serious guys, it is physically impossible to be going that fast, and I am ailling to bet my damn car on the fact that I was NOT doing 70. And I never leave 3rd gear in the city. Considering you all beleive me, what are the possibilities? (PS the fucker was rascist, said "we have laws in this country, this isnt home").

1st thing i say when a cop clocks me speeding is "can i see your certificate saying that radar gun is calibrated and your certification so you can use it?"

usually that question right there gets me out of 90% of my tickets.

as for 70mph when you were really doing 55, plead not guilty to it, cops rarely show up to hearings like that so the judge will dismis it

96TSi: I will challenge this and plead not guilty. I was in such a dilemma yesterday. The cop basically LIED and threw the ticket at me in such a hurry, the whole thing lasted 1 minute, I didnt have time to explain myself or anything. That moustachioed rat. 70 mph....that was the first time I had ever been pulled over, and though I speed, I leave the 70mph-in-the-45mph-zone idea for the people we see being busted on Cops. I cant beleive this crap.

Here if you ask for the calibration info on the gun or the cops certification, you will be garanteed to get a ticket. Rule #1, dont piss off the cops. Thats just stupid ;) Additionally, one of the only ways to beat these things in court is to ask for this info, and catch them off guard (they wont bring it). If you ask for it before the court date, they will certainly come prepared. ;) Again, not smart. And as for hoping the cop wont show up, in this state the cop doesnt have to. There is one cop that does all traffic hearings for the day. And they rotate it seems.

In all honesty there is very little chance you will get out of this. In my experience the judge will always lower the fine to the minumum, but that has no effect on the insurance surcharges you'll be paying for the next 6 years (roughly 1200 bucks ;) ) And never say "I wasnt going THAT fast," the judge will just say ok, you were going 65. Here's your fine.

You're best bet is to just try to convince the judge that you werent speeding at all. But they hear that shit all day from everyone. Good luck. :)

you can go on google and type in "fight my ticket" it will talk about stuff u mite want to use. i do wat 96tsi did and i got out of one like that before. he said "your a brite young man for asking me for that, i wont give you the ticket" lol i was shocked it worked. juss try to fight it they probably give you traffic school and it wont show up on your record or your insurance. good luck

Guys I am going nuts. I hope that b@stard burns in hell. I work 50 hours a week and have full time college. The last thing I would ever do is get myself into this kind of time-wasting money-depleting record-staining shit.

I think the judge is going to kick my ass if I plead guilty. He'll be like, "70 mph in a 45 mph zone son? Youre a reckless driver and here's your $1000 fine and it'll stay on your record FOREVER!! Muhahahahha!" If it was 55 mph like I knew I was doing, I wouldnt even fret... but it's such a fucking LIE... might as well wouldve added 30 more miles to make it a fucking 100. So, plead guilty or not guilty? (I'm in CA).

I had almost the same thing happen to me. I was doing 40 in a 35, got pulled over and the cop told said he clocked me at 47, there was a guy driving right next to me, and the cop said he clocked him at 42. Now I know for a fact that I wasnt going 47. I was talking to a guy that was a retired cop and he told me to definately fight it because I was hit with the wrong reading, he told me that I should ask for calibration records to. ( they are supposed to calibrate 3 times a day) So I set up a court date to fight it, then I got pulled over again going 101 in a 65 so I didnt even bother fighting the first one and just paid the $120 fine.

I believe you, it a speed trap on a congested road, there isnt time to try to state your case. If you do contest, clean up b4 you go. My bro got an auto theft charge dropped cause he cut his hair and the cop didnt recognize him! He was just the passenger anyway, it was a domestic spute that got them in trouble.
I got out of a ticket once, the officer didnt believe his own gun when he clocked my 87 VW fox at 92 mph! He didnt realize I saw him first and had already slowed down! Honda or VW, or whatever, they can all get up and go, on the right road!
You just never know when or where, but it is either going to be good or bad! Wait till the time comes when you can laugh about it!

I live in CT, and what I usually do is to ask to see the radar. Here, they have to show you the radar if you ask, or they cannot give you the ticket. You can't be charged without evidence. I know that doesn't help now but it will in the future.

last month i got a speeding ticket for 72 in a 50. but i had the exact opposite thing happen to me. I WAS REALLY GOING 115 easy.

I was at a light and this acura integra pulls up next to me reving his engine. SO naturaly i had to whoop his ass. its instinct. well the cop was in the woods around this bend i went around the bend doing 115+ then i see a cop fly out i was like F*** there goes my new jersey driving privlages. Well he asked me how fast i think i was going, I said i dont know mabye 65. and he replied with a no u where going 72 in a 50 i was so releived. that was the first speeding ticket i was accually happy after recieving it. :)

if you live in cali and its your first ticket, i think no matter what they give you traffic school. that way it wont show up on your record or insurance. juss bs and tell the judge your tight on money going to college and all. i live in cali i got caught 65 on a 35, second offense on speed and they still gave me traffic school and not show up on my record. so youll be fine, juss a slap on the wrist. no 1000 fine.

cops are assholes!! thats just how life works, i keep evading them but you could try pulling the fact that he said the "we have laws here, this isn't home" bit and see if that gets u ne where w/ racial profiling they might throw it out... and in cali how racists can a cop get away w/ being!?

a guy i kno got a ticket for 36 in a 35, his mom called the station and said it was BS and they threw it out, around here the cops suck so if u can take off fast enough they'll never catch you

That is what I was looking for, someone with a similar experience! I guess 65 in 35 is pretty much the same as 70 in 45... so you plead guilty and got traffic school? I really do work full time and go to college fulltime, the judge better be lenient or I'm toast!

I was pulled over for going 83 in a 55 once here in CA so i know how you feel because i was only going about 70. I have had a lot of friends fight tickets though and all of them have gotten out of it cause the cop didnt bother to show up. If you end up losing your case though it shouldnt be as bad as the $1000 you said before cause mine was a second offense and it was $370. sorry to hear about your incident but good luck with it.

Does anyone know what questions I should be prepared to ask the court directed to the officer to prove my innocence, if he does indeed show up? Something like "I would like to see proof that the gun was calibrated correctly on that day" etc etc...?

sphyder, my post was not for you. i did read it, my post was for the people who were actually going 25+ over the speed limit and then get pissed when they get pulled over.

From what you said the cop made a mistake and because of that i think you should be let off.

But its just stupid if someone gets pissed off that they were excessivly speeding and gets pulled over for it. If the cop made a mistake thats a different story. BUT if you know what your doing and going 30 over its clearly no accident if you get pulled over, such as george saying he was doing 65 in a 35.....did you really expect to not get pulled over if there was a cop present???

So sphyder i understand where you are coming from because if you are telling the truth he did make a mistake, and if thats the case it should be thrown out.....but my post was not for you

LOL... that is usualy my story... 'you were doing 97 but i'm only gunna site you for 75, blah, blah, blah, you got a donut... blah, blah, blah'

i would fight it, and go take some pictures of the site of the ticket at the prescribed time for a couple of days. that way you at least have more than just a bit of luck [the cop may be on the ball because he gave a bunch of tickets that day in that spot and any that he gave will all have the same hearing date and if fought will get the same calendar day to re-appear]. you may want to get an extension for a court date then go to court and fight it. but go to the courthouse a couple days before the ticket date after 2pm [there are 2 sessions you can make it to, 8am and 1pm] and tell them you can't make it to the designated court date and want to fight it anyways, can you get an extension, blah.

I went into a "do not enter" in a school zone during school time, i pleaded not guilty and the judge AND the cop didn't show up, lol. cops don't get paid to show up in court so if your hearing is EARLY in the morning, your probably off the hook.

no sphyder, it just bugs me when people get pissed when they get pulled over for actually doing something.....they act like the cop shouldnt be doing his job. But if in fact you werent speeding then you should be let off. i was just using the speeds as an example, not actually towards you.

well yea dont worry about it. juss tell them wat happen. question the gun. say you werent going that speed. and watever happens they most likely give you traffic school..., unless the judge has something up his ass, and his wife left him that morning, other than that youll be fine.

One way you can get out of the ticket and it works most of the time. When your in court, ask the cop if he calibrated his gun recently. If he says yes, ask for his certification papers as a technician. Most of the time, they'll give you a certificate says they can check calibration, but they CAN'T calibrate it themselves. If this is the case, reply. No, i would like to see your technician certificate. They'll probably say they don't have one. Then you ask them, "Then why did you say you calibrated your gun if aren't certified to, How are we supposed to rely on your reading if you calibrated a gun your not certified to?" Turn to the judge. Technically, the judge has to dismiss it.

EDIT: Remember, i said most. This may not work ALL the time.
